Mäklarhuset Real Estate Sweden AB, org. no. 556552-1381, Vädursgatan 6, 412 50 Göteborg (”Mäklarhuset”) is responsible for personal data processing. Mäklarhuset processes personal data in accordance with the applicable legislation, including the General Data Protection Regulation.

The terms ”we, ours, our and us” below refers to Mäklarhuset.

1 Data Controller

Mäklarhuset is responsible for processing the personal data that you submit to us or that we collect about you.

2 What personal data do we process?

The data being processed is personal data that you provide us with, that we collect from you or that we receive from others.

Personal data you have provided us with
By having an account on www.maklarhuset.se (the “Site”) you have the possibility to create and manage watch criteria for objects, book showings, follow and take part in bidding processes and follow sales (the “Account”). We process the personal data that you provide us with when you submit an offer for purchase or sell private residences, commercial premises, cottages, property, estates or farms that we sell (the “Object”).We also process the personal data that you provide us with by creating an Account on the Site, calling us, contacting us via text message, email or chat, register for our newsletter, create or manage watch criteria on the Site, book showings or when you exercise your right as a consumer to claim fault and delay liability against Mäklarhuset. The personal data that you provide us with and that we process can e.g. be your name, address, mobile and telephone numbers, email address, date of birth, personal identification number, date and time of our contact with you, account number, information about current bank, loan guarantees from the bank, loan guarantee amount, bid and final price of an Object, if you have a relationship with another account holder, details of which showings you have been on and information about your selected watch criteria on the Site such as area, type of Object, price, living area, plot size, number of rooms, balcony and new productions.

Personal data that we collect from you
When you use the Site or your Account we will also collect personal data about you. It can e.g. be information with respect to what dispatches and information you have received from us and what services you use.

Personal data about you that we receive from others
Mäklarhuset may receive email and other correspondence that contains personal data about third parties and Mäklarhuset will therefore process such personal data. If required Mäklarhuset will inform you as third party about the processing.

Mäklarhuset may also happen to receive access to personal data via public registers such as SPAR, BRF and Lantmäteriet.

3 Why do we process your personal data and what legal basis do we have for the processing?

Communicate with us
When you call us, your telephone number is checked against existing information about you through www.hitta.se and in our customer registry. We do this to be able to provide you with personal service. Your name, telephone number, date and time of the call is saved in a log with us. The legal basis for the logging of the conversation is that it is necessary for the purpose of a legitimate interest of Mäklarhuset. A legitimate interest to log calls with you exists since it helps us to meet your needs and provide you with the best possible service. Our interest in processing your personal data for this purpose therefore precedes your possible interest in protecting your personal integrity. If you currently are or become a customer with us in the future, your data will be saved in your Account.

Mäklarhuset will also process your name, address, email address, mobile and telephone numbers that you submit to us by having contact with us via email, text message or our chat function. Through the chat function you have the possibility to ask our agents questions. The agents can thereafter choose to publish the question and answer on Mäklarhuset’s website. The legal basis for processing is that it is necessary for the purpose of a legitimate interest of Mäklarhuset. A legitimate interest to process personal data exists since it makes it possible to answer your questions and provide you with good service. Our interest in processing your personal data for this purpose therefore precedes your possible interest in protecting your personal integrity.

Your Account on the Site
Your Account on our Site can be created by you personally on the Site, by one of our agents on your behalf or automatically when you request one of our collaboration partners to provide us with your data. Mäklarhuset will process your name, address, mobile and telephone number, information about your watch criteria on the Site, if you have a relationship with another account owner, data about the showings you have attended, data about what dispatches and messages you receive from us, and what services you use for the purpose of administering your Account and the services that are made possible for you through the Account, i.e. to create and manage watch criteria, follow and take part in sales and bidding and booking showings. The legal basis for Mäklarhuset’s processing of your personal data in this section is that it is necessary for the performance of a contract with you or to take steps to enter that contract. Mäklarhuset will also process the above-mentioned personal data for the purpose of being able to handle any possible request to make use of your rights as a consumer to claim fault or delay liability against Mäklarhuset. The legal basis for such processing of your personal data is that it is necessary for Mäklarhuset in order to be able to fulfill a contract with you and the legal undertakings that are incumbent on Mäklarhuset according to the Consumer legislation.

If you do not provide us with the above-mentioned personal data we do not have the possibility to deliver all of our services and fulfill our commitment to you. If you would only like to take part of information on the Site you are not required to submit any personal data to us.

Sales
If you purchase, sell or consider selling an Object through us, we will process your name, address, mobile and telephone numbers, email address, personal identification number, your bank information, purchase agreement and pictures pertaining to the residence in order to administer the sale such as to enable valuation, styling, photography, advertising, showings, the bidding process, final price, payment and possible mortgage. The legal basis for the processing is that it is necessary for Mäklarhuset in order to be able to fulfill a contract with you. The personal data processing also occurs in light of the legal basis that Mäklarhuset’s processing is necessary for the purpose of fulfilling legal obligations that are incumbent on Mäklarhuset.

If you submit a bid on one of the Objects that Mäklarhuset’s real estate agents sell we will process your name, address, mobile and telephone numbers, email address, date of birth, personal identification number, information about your current bank, loan guarantee from the bank,the loan guarantee amount, your bids and final price in order for you to be able to follow and participate in the bidding process. The legal basis for the processing is that it is necessary for Mäklarhuset in order to be able to fulfill a contract with you and to be able to fulfill legal obligations that are incumbent on Mäklarhuset.

Marketing of our business
Mäklarhuset will process information about the Object, namely address, pictures and final price, in order to market Mäklarhuset and Mäklarhuset’s business. The marketing is made through our own and our partners’ channels and social media. The legal basis for the processing of your personal data is that it is necessary for purposes relating to our legitimate interest, which outweighs your interests, rights and freedoms. Mäklarhuset’s interest in marketing the sales we have contributed to outweighs your potential interest in protecting your personal privacy.

Newsletter
If you have an Account, Mäklarhuset will process your name and your e-mail address in order to send you newsletters and information about interesting Objects to you by e-mail. The legal basis for our processing of your personal data is that it is necessary for purposes relating to our legitimate interest, which outweighs your interests, rights and freedoms. A legitimate purpose is, for example, to market products and services that we believe that you may be interested in. Mäklarhuset’s interest to send offers and information to you outweighs your potential interest in protecting your personal privacy.

Customer care and quality assurance
Mäklarhuset will process your name, address, email address, mobile and telephone numbers as well as dates and times of our contact with you and information about the Object for the purpose of taking care of our customer relation with you and to quality check our operations. The legal basis for this is that the processing is necessary in order for Mäklarhuset to be able to fulfill a contract with you or to take measures prior to the performance of such a contract, or that it is necessary for purposes relating to our legitimate interest, which outweighs your interests, rights and freedoms. Mäklarhuset’s interest to quality check its operations outweighs your potential interest in protecting your personal privacy.

Accounting
Mäklarhuset will for the purpose of accounting process information about the transaction that has taken place between Mäklarhuset and you as the seller or purchaser of an Object that we sell. Mäklarhuset will for that reason process your name, address, mobile and telephone numbers, email address, personal identification number and your bank information. The legal basis for Mäklarhuset’s processing of your personal data is that it is necessary in order to fulfill a legal obligation that is incumbent on Mäklarhuset.

Archiving
Mäklarhuset will process the information that is necessary for the Swedish Estate Agents Inspectorate supervision for the purpose of fulfilling the archiving obligation that is the responsibility of Mäklarhuset. The legal basis for Mäklarhuset’s processing of your personal data is that it is necessary in order to fulfill a legal obligation that is incumbent on Mäklarhuset.

In order to prevent money laundering and financing of terrorism
If you sell or purchase an Object through Mäklarhuset, we will process your name, address, personal identification number, account number and copy of ID documentation for the purpose of attaining customer recognition and to prevent money laundering and financing of terrorism. The legal basis for Mäklarhuset’s processing of your personal data is that it is necessary in order to fulfill a legal obligation that is incumbent on Mäklarhuset.

4 To whom do we disclose your personal data and where do we process it geographically?

Your personal data may be disclosed to and processed by others. We disclose your personal data to our partners. On the following page are the names of the companies that we share your personal data with listed https://www.maklarhuset.se/om-maklarhuset/partners. We also disclose your personal data to other real estate agents if you are a seller or have visited a showing of an Object that we have had for sale that is being handled by another real estate agent.

We also disclose your personal data to our service providers who process personal data on our behalf, so-called data processors. We have agreements with our data processors, which ensure that they process your personal data in accordance with this policy and our instructions.

Mäklarhuset may also share your personal data to authorize a fusion, an acquisition or a sale of all or portions of Mäklarhuset’s assets.

We may also share your personal data with public authorities that request it.

Mäklarhuset will process your personal data both within and outside of the EU and the EEA. Mäklarhuset will take the necessary measures to ensure that the transfer takes place in a legal manner and that your data continues to be protected by the receiving parties outside of the EU and EEA.

5 How long will we process the personal data?

We only process personal data as long as there is a need to preserve them in order to fulfill the purposes that the data was provided or collected for. The same personal data can be stored in several different places for different purposes. This can mean that information which has been removed from the system because it is no longer required for that purpose may remain in another system where it is stored based on consent or for another purpose where the personal data is still required.

Personal data that is processed in connection with logging of conversations with persons who do not have an Account with us are saved for a period of one month.

Personal data that is processed in order to enable your contact with us via email, text message or our chat function is saved as long as you have an Account or for five years if you do not hold an Account.

Personal data that Mäklarhuset processes for the purpose of administering your Account and the services that are made possible through the Account, or to fulfill our contract with you, e.g. fulfill responsibility for fault or delays, will be processed as long as you have a registered Account with Mäklarhuset. Information regarding your watch criteria on the Site is saved for six months as long as you do not announce that you would like the watch criteria to remain for a longer period.

The personal data that Mäklarhuset processes for the purpose of marketing our business is processed for one year after the sale of the Object.

Personal data that Mäklarhuset processes for sending newsletters will be processed as long as you have an Account. You can at any time inform us that you no longer want newsletters by clicking on the link at the bottom of the newsletter or by contacting us.

Personal data that Mäklarhuset processes about you as the purchaser, seller, potential seller or bidding party in order to enable for you to follow and take part in the bidding process as well as to carry out the sale of our Objects is saved for ten years after the contract has been entered into. This is because the information may be required for use in an insurance case regarding hidden fault. Pictures, address and information that is pertinent to the valuation of an Object is saved for five years.

Personal data that is processed by Mäklarhuset for the purpose of caring for our customer relationships and follow-up the quality of our services is processed for 10 years after you have been in contact with us.

Personal data that Mäklarhuset processes for accounting purposes is saved for seven years after the transaction in accordance with applicable accounting legislation.

Personal data that Mäklarhuset processes for archiving purposes is saved for 10 years after taking possession of the Object in accordance with applicable legislation.

Personal data that Mäklarhuset processes in order to prevent money laundering and financing of terrorism is saved for five years from the time measures for customer recognition are taken.

Your personal data may be saved longer than what is stated above if it is required in order to follow legal requirements or decisions by official authorities.

6 Your rights

Right to correction and extract of register
Mäklarhuset will take measures in accordance with applicable legislation to maintain your personal data correct, complete and updated. You have the right to correction of incomplete or incorrect personal data. Furthermore, you have the right to request an extract of register regarding your personal data that we process.

Right to object to processing
If the processing of your personal data is based on a balance of interest and you believe that your integrity interests outweigh Mäklarhuset’s legitimate interest of processing your personal data you are entitled to object to the processing, on the basis of the reasons pertaining to your specific situation, by contacting us via the contact details specified in item 1.1. If you object to the processing we must demonstrate a compelling justified reason to continue the processing of your personal data. You are also always entitled to say no to processing of your personal data that takes place for direct marketing purposes.

Right to deletion
Under certain prerequisites, such as when you have revoked previously submitted consent and there is a lack of other legal grounds for continued processing of your personal data, you are entitled to request that your Personal data be deleted.

Right to limited processing
Under certain prerequisites you are entitled to limit the processing of your personal data to solely include storage of personal data, e.g. during the period we investigate whether you have the right to deletion.

Right to access
You are entitled to receive a confirmation from Mäklarhuset that your personal data is processed by us and if such is the case, receive access to the personal data and the following information:

  • purpose of the processing;
  • the categories of personal data that are processed;
  • receivers of personal data (especially if such are located outside the EU/EEA);
  • the time period during which the personal data is processed;
  • information about the rights that are mentioned here;
  • information about the source from which the personal data is collected from; and
  • in the event of automated decision-making, including profiling.



In addition, you are also entitled to request the right to receive copies of your personal data in a common electronic format.

Right to data portability
You are entitled to receive the personal data that we process about you, in a structured, generally used and machine-readable format and have the right to transfer this information to another data controller when such is technically possible.

Complaints to supervisory authorities
You are welcome to contact us with questions or complaints with respect to the processing of your personal data. You are also always entitled to submit complaints regarding the processing of your personal data to:
